1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Creator", or "You") and BehaveIQ Creator Intelligence Technologies (operating as "BehaveIQ", "we", "us", or "our"), governing your access to and use of the website at https://www.behaveiq.in, its subdomains, backend APIs, and web software.

By signing up, logging in via Google OAuth / Firebase, accessing our dashboard, or purchasing a subscription via Razorpay, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Cancellation & Refund Policy. If you do not agree to all terms, you must discontinue using our services immediately.

2. Eligibility & Account Registration

• You must be at least 18 years old or possess legal parental/guardian consent in your jurisdiction to use BehaveIQ.
• You must register and authenticate using Google OAuth (Firebase Authentication). You agree to maintain the security of your Google credentials.
• You are solely responsible for all activities that occur under your account. If you suspect unauthorized access, notify us immediately at support@behaveiq.in.

3. YouTube™ API Services & Third-Party Terms

BehaveIQ utilizes the YouTube Data API v3 to retrieve publicly available channel statistics, video metrics, titles, tags, and audience comments to provide creator analytics and benchmarking.

You can revoke BehaveIQ's access to your YouTube channel data at any time via the Google Security Settings permissions page.

4. SaaS Subscription Plans & Payment Terms

BehaveIQ offers tiered plans (Starter, Pro Growth, Enterprise Studio) on both monthly and discounted annual billing cycles:

• Free Starter Plan: Provides baseline channel auditing and outlier detection subject to monthly quota limits.
• Paid Subscriptions (Pro & Enterprise): Provide expanded audit quotas, competitor tracking, Mistral AI generations, and advanced comment intelligence.
• Payment Processing: All monetary transactions are processed securely through our authorized payment gateway partner, Razorpay Software Private Limited. We do not store or process your raw credit card numbers, debit card details, or UPI PINs on our servers.
• Taxes: All fees are exclusive of applicable Goods and Services Tax (GST) or relevant local taxes unless explicitly stated otherwise.
• Auto-Renewal: Subscription renewals are billed automatically at the beginning of each billing cycle until cancelled by you through the user dashboard or by contacting support.

5. Acceptable Use Policy & Restrictions

You agree NOT to engage in any of the following prohibited behaviors:

• Using automated scrapers, bots, or unauthorized scripts to extract data from BehaveIQ outside our documented APIs.
• Attempting to probe, scan, or compromise our infrastructure, rate limiters, or authentication endpoints.
• Reverse engineering, decompiling, or disassembling any source code or models comprising our software.
• Reselling, sublicensing, or distributing BehaveIQ access to unauthorized third parties without our prior written consent.
• Using the service for unlawful harassment, defamation, copyright infringement, or any activity that violates the YouTube Developer Policies.

6. AI Content & Predictive Analytics Disclaimer

BehaveIQ provides automated title recommendations, packaging scores, and audience sentiment summaries powered by machine learning algorithms (including Mistral AI) and statistical outlier analysis.

No Financial or Performance Guarantee: These insights are advisory benchmarks based on historical public data. We do not guarantee that adopting recommended titles, thumbnails, or topics will result in higher YouTube view counts, subscriber growth, search rankings, or ad revenue. All creative decisions remain the sole responsibility of the creator.

7. Intellectual Property Rights

All copyrights, trademarks, interface designs, algorithms, code, database structures, and brand assets associated with BehaveIQ are the exclusive property of BehaveIQ Creator Intelligence Technologies or its licensors.

You retain all ownership and intellectual property rights in your original YouTube content, videos, channel artwork, and descriptions. By analyzing your channel with BehaveIQ, you grant us a non-exclusive license solely to process and display the relevant public analytics for your personal dashboard.

8. Termination and Account Suspension

We reserve the right to suspend or terminate your account and access to the services at our sole discretion, without prior notice, if you breach these Terms, misuse API quotas, engage in fraudulent payment disputes, or violate YouTube's Developer Policies.

You may terminate your account at any time by navigating to Settings or by requesting account deletion via support@behaveiq.in.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BehaveIQ Creator Intelligence Technologies, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, YouTube channel demonetization, data loss, or business interruption arising out of your use or inability to use our services.

Our total aggregate liability under any circumstances shall be limited to the total fees actually paid by you to BehaveIQ in the three (3) months preceding the incident.

10. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to your use of BehaveIQ shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

The courts located in New Delhi, India shall have exclusive jurisdiction over any legal disputes or proceedings arising hereunder.
